Resolutions on amendments to the Procurement Code

Confindustria actively participated in the definition of the New Public Procurement Code on which, one year after its entry into force, it is possible to make an initial assessment.

From a more strictly operational point of view, there is an awareness that the reform implemented with the new Code can only be effectively realised if two fundamental objectives are achieved: the full implementation of digitisation and the effective qualification and, consequently, the substantial reduction in the number of contracting stations.

On the Procurement Code, However, some critical issues remain, to which Confindustria drew attention at this hearing:  

  • On price revision mechanismit should be clarified that in line with the literal fact of the provision, 5% is only the trigger for the revision mechanism, while the 80% to be liquidated is to be calculated with respect to the entire change that has occurred.
  • With reference to the special sectorsThe need to supplement the ISTAT price revision indices with indices suitable for representing the sector is highlighted energy-related specialities.
  • With reference to the award criterion of the most economically advantageous tender it is important to provide that contracting authorities correctly identify and value the elements that make up the tender, giving prominence and prevalence to technical aspects and qualities of the same. Confindustria considers it indispensable restore the mechanism of the 70/30 balance between quality and price.
  • The proposal in the resolution is considered positive which provides for the reintroduction of the ceiling on economic score (maximum 10%).
