Confindustria agrees with the ratio of the PdL to bring clarity and certainty to the uniform application of regulations on odorous emissions throughout the country. However, beyond the technical considerations, it is important to consider that the market in which companies compare themselves is international and that therefore the possible introduction of a reference framework, especially in terms of emission limits, that is more stringent than those in force in other countries, may inevitably determine a weakening the competitive position of Italian companies in the market.

It should also be considered that, given the lack of specific technical references and unambiguous tabular limits set at EU level, it would be more appropriate to define in the first instance "target values', instead of 'emission limit values', the exceeding of which does not lead to penalties but only to possible further mitigation actions.

In any case, any target values must be compatible and achievable according to the technical feasibility and economic sustainability. This recommendation is made in order not to introduce penalising elements for domestic production and distorting elements of free competition under EU law.
