The bill 'Provisions and Delegation of Authority to the Government on Artificial Intelligence', which is inspired by the European Artificial Intelligence Regulation (AI Act), aims to regulate the use of artificial intelligence and promote the use of new technologies, identifying a series of provisions and principles aimed at protecting the fundamental rights of the individual.
Generally speaking, the principles referred to in the provision do not seem to be particularly critical at the moment, barring overly restrictive interpretations by supervisory authorities in the future. The reference to access to high quality data is also positive, given the role of data as a crucial enabling factor for the development of effective artificial intelligence systems.
Confindustria instead points out how criticality the fact that the approach of the bill deviates from the risk category and use case approach followed by the European Union's Artificial Intelligence Act. This divergence, in fact, could affect the principle of proportionality applied to some provisions, in particular for the use of artificial intelligence in health or labour matters, where some obligations could be excessively restrictive if applied to artificial intelligence systems with little or no risk, according to the assessment criteria of the AI Act.
