The Ministry of Justice approved the new version of the Confindustria Guidelines for the adoption of organisational models 231.
The guidelines provide companies with useful methodological indications for the elaboration of models, which represent an increasingly widespread organisational framework in our business fabric.
The latest update covered both the general and special sections, with specific interventions on various topics.
In the general part, the main novelties concern: the discipline of whistleblowing, the updates following the so-called Spazzacorrotti Law and the opportunity to enhance the integrated approach to whistleblowing. Spazzacorrotti and the opportunity to enhance an integrated approach to the compliance.
In the special part, the guidelines have instead been supplemented with paragraphs devoted to the new offences covered by liability 231 (e.g. private bribery, corruption, market abuse, self-laundering and money laundering, trafficking in unlawful influence, tax offences, smuggling, embezzlement offences).
