On 31 March 2023, Legislative Decree No. 36 of 2023 on the new Public Contracts Code was published in the Official Journal.
Confindustria analysed the different profiles of the new legislation in the position paper that was presented during the Conference on 28 June 2023: “The New Public Procurement Framework: A Paradigm Change”.
The document dwells on the provisions of greatest interest to the companies of the association system and highlights their positive and critical profiles, with particular reference to the services and supply sectors. This is consistent with the position previously outlined at the hearing on the draft legislative decree.
In general, the position paper expresses appreciation for the adoption of a policy strategy based on effective actions, definite timeframes for implementation and incisive interventions to boost investments, including those of the NRP, and for the transition from an “Anti-Corruption Code” to a “Code of Doing” aimed at the economic recovery of the country-system.
In terms of substance, the document points out that the new Code continues to lack an adequate differentiation between the world of works and that of services and supplies, which, instead, deserves specific attention.
