Confindustria welcomed Law No. 81/2017 that regulated, for the first time, 'agile work' as a "mode of execution of the employment relationship also established by agreement between the parties', because of its many innovative aspects, first and foremost the special valorisation of the individual agreement and the 'elastic' regulation of working time.

The set of new proposed laws on agile work, although well differentiated in their approach, risks being excessively pervasive. In our opinion, in fact, the current discipline does not need a further broad and comprehensive legislative intervention, but possibly some targeted and specific interventions, such as those aimed at recognising incentives for companies that commit to providing adequate IT equipment for their employees; at clarifying certain aspects of the health and safety discipline of agile workers; and at simplifying the discipline of telematic communications.

For these reasons, Confindustria welcomed the recent initiative of Minister Orlando, who convened the social partners, inviting them to verify whether there are the prerequisites for the definition of a framework agreement that would guide the intervention of collective bargaining on agile work in the regulation of various issues such as, for example: disconnection, the indication of the most appropriate places where agile work can be performed, the regulation of the provision of IT equipment for training, the recognition of the full exercise of trade union rights, gender equality and economic treatment, and the protection of fragile workers.
