The draft legislative decree laying down supplementary and corrective provisions to Legislative Decree No 116 of 2020 on packaging and packaging waste aims to ensure regulatory coordination and consistency in relation to the amendments and repeals that have affected the Environmental Code over the last two years.
The measure provides elements that go in the right direction to bring our order into line with the European one, however there are two critical aspects that concern the change in the discipline of waste classification and the effects of this on the scope of application of the TARI, and the changes in the area of deposit and reuse of packaging.
With regard to the changes on the TARI, Confindustria emphasised the need to maintain the current regulations, without making any changes so as not to burden companies unfairly.
With regard to the issue of packaging precautions, Confindustria pointed out that it is advisable to focus on the new EU Circular Economy Action Plan before changing our regulations. It is therefore important not to expose our country to leaps forward that seem to disregard the principles governing the European single market.
